Elon Musk, until very recently one of the strongest backers of President Donald J. Trump, has announced his intention to form a “third-party” opposition to what he refers to as the GOP/Democrat “uni-party”—and, indeed, just today Musk filed with the Federal Election Commission to form the newly created “American Party.”

Might it be more difficult to get a third-party off the ground than Trump envisions? What would the American Party stand for that is not already largely captured by the MAGA wing of the Republican party? Federal Judge Brian Murphy—the unelected, black-robed, tyrannical, inferior federal district trial court judge raised to the federal bench on December 6, 2024, a FULL MONTH AFTER the re-election of President Donald J. Trump, was a mere 200 days on the bench when he had the dubious honor to be checked by the US Supreme Court itself on June 24 of this year, when SCOTUS paused the injunction Judge Murphy had issued against Trump’s efforts to deport murderers and other violent illegal migrants from our great nation.

That SCOTUS check didn’t even give Judge Murphy pause, however, as the SAME DAY he issued an order informing the White House that the SCOTUS ruling against him nevertheless left him with the authority to order about the President in the exercise of his core and plenary Article III Executive Branch authority as if Trump were a mere clerk in Judge Murphy’s court.

Naturally, Trump immediately appealed this lawless judge’s order right back to the Supreme court.

A mere 9 days later, yesterday, July 3, 2025, SCOTUS was obliged to issue a rare “clarification” of its June 24 order against Judge Murphy, explaining as if to an idiot that their ruling against him was COMPREHENSIVE, and not something around which a judge on the federal bench for a mere 209 days was free to wiggle around.

Yesterday the Progressive Fascists and their collaborator unelected, black-robed, tyrannical, inferior, federal district trial court judges were stripped by the Supreme Court of their ability to weaponize universal temporary restraining orders and preliminary injunctions against the political agenda of President Donald J. Trump, the Article II Executive Branch people elected by the whole of the American people to carry out their political win.

Their response? To glibly announce that the loss of universal injunctions doesn’t really matter, because instead they’ll just file a blizzard of class actions to certify universal classes, and then obtain injunctions that apply to those universal classes.

The outcome, they claim, is pretty much the same either way.

But IS it? If both universal injunctions and class actions achieved the same outcome, why have they pursued only the former and not the latter? And how do they plan to define these coherent classes, anyway?

In fact, the pursuit of class actions leaves these Progressive Fascist enemies of the American citizenry in a far more legally vulnerable position than they’ve ever been before.
