La novela MADAME BOVARY fue publicada en seis entregas entre el 1 de Octubre y el 15 de Diciembre de 1856 en la Revue de París, luego de un penoso y agónico proceso de escritura que duró cinco años y dio a luz a la novela que se constituyó en un hito de la literatura moderna.
Apenas 3 semanas después, el 7 de Enero de 1857, comenzó un juicio contra el autor, los editores de la revista y el dueño de imprenta por ofensas a la moral pública y religiosa.
La resolución de la Justica fue conocida el 7 de Febrero y absolvió de los cargos a los inculpados y se limitó a una reprimenda sobre el valor social que debe tener la literatura.
Esta recreación del juicio se basa en la transcripción de las actas del juicio.
La discusión acerca de la relevancia de los delitos imputados no tiene sentido hoy en día. Madame Bovary es incriminada por una serie de escenas en que el narrador sostiene una mirada lasciva sobre la protagonista, mezcla lo sagrado con lo profano en la instancia de la extremaunción a Emma, y se enumeran sus pecados y sus bellezas corporales.
La relevancia de este juicio radica en ser testigo de cómo la literatura comienza a ser una esfera autónoma, que sólo debe justificar sus temas, formas y procedimientos ante el público.
Las actas de este juicio nos permiten volver al momento en que se empezó a pensar la separación entre autor y narrador, una nueva poética que enarbola Flaubert como parte de la estética realista, a la supresión de la jerarquía entre temas altos y bajos y al tratamiento del narrador y del punto de vista.
Un argumento esgrimido en contra de Flaubert tiene que ver con el efecto que podría producir la lectura de la obra en el público femenino, efecto que luego se conocería como “bovarismo”. Flaubert no deja dudas al respecto: “No escribo para muchachitas, escribo para el hombre culto”.
En su veredicto, el tribunal consideró que la novela no condenaba efectivamente a su heroína por sus pecados, que su descripción de personajes y conductas conduce a un realismo que implica la negación de lo bello y de lo bueno”, que los escenas incriminadas eran reprochables, pero escasas en la extensión total de la novela y, finalmente, que Flaubert “cometió el error de perder a veces de vista las normas que todo escritor que se respete nunca debe violar”. El tribunal decidió finalmente que no había causas suficientes para encontrar al autor culpable del delito que se le imputaba.
El juicio a Gustave Flaubert ha sido sin duda una contribución importante al éxito editorial de la novela y a su instalación como la piedra fundacional de la literatura moderna.
